OilExchange is not responsible for the content and accuracy of information and other materials submitted to it by its users. Because of the volume and type of materials submitted to OilExchange, OilExchange cannot be responsible for verifying any facts contained in such materials.

BY ACCESSING OILEXCHANGE.COM. A USER ACKNOWLEDGES AND AGREES THAT (I) OILEXCHANGE IS NOT WARRANTING OR INSURING THAT OILEXCHANGE’S SERVICES WILL BE FREE FROM ERRORS, OMISSIONS, INTERRUPTIONS, DELAYS, LOSSES OR DEFECTS, WHETHER HUMAN OR MECHANICAL, (II) OILEXCHANGE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AS TO ITS SERVICES INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, (III) IN NO EVENT SHALL OILEXCHANGE EVER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES SUFFERED BY A USER EVEN IF FORESEEABLE, AND (IV) OILEXCHANGE’S LIABILITY TO A USER FOR ANY REASON SHALL BE LIMITED IN EVERY INSTANCE TO A REFUND OF ANY FEES PAID TO OILEXCHANGE BY SUCH USER.

By accessing an OilExchange Web Site each user also agrees: (i) not to wrongfully access OilExchange or to improperly distribute information taken from OilExchange; (ii) not to utilize OilExchange in any manner which could overburden, disable, impair or damage an OilExchange Web Site, (iii) not to interfere with any other authorized Party’s use of OilExchange and (iv) not to sue OilExchange for any sum of money in excess of the fee paid by the user to OilExchange.
